Welcome to Velvet Hammer Luxury. These Terms of Service ("Terms") govern your access to and use of velvethammerluxury.com (the "Site") and your purchase of any products through it. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who We Are

The Site is operated by Velvet Hammer Luxury [LLC], based in Portland, Oregon, United States ("Velvet Hammer," "we," "us"). We are an independent reseller of pre-owned, authenticated luxury goods. We are not affiliated with or endorsed by any of the brands whose products we sell — see our [Legal Notice] for full trademark disclosures.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to purchase from the Site. By placing an order, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Products, Descriptions & Pricing

Every item we sell is pre-owned and one of a kind. We describe condition honestly and in detail, including known flaws; slight variations in color may result from lighting, photography, and screen settings, and measurements are approximate.

Because our inventory is one of a kind, an item may occasionally be purchased by another customer moments before your order completes, or may be found on inspection to no longer meet our standards. In these rare cases we will cancel and fully refund your order promptly.

We work hard to keep pricing accurate, but errors happen. If an item is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and issue a full refund, even after an order confirmation has been sent.

All prices are in US dollars unless otherwise stated.

4. Orders & Payment

Your order is an offer to purchase; it is accepted when we ship the item. We reserve the right to refuse or cancel any order at our discretion, including orders that trigger fraud screening, orders shipping to addresses we cannot verify or insure, or orders we reasonably believe are placed for resale in violation of these Terms.

Payment is processed at checkout through [Shopify Payments / your payment providers]. You represent that you are authorized to use the payment method provided. If your payment cannot be verified or is declined, we may cancel your order.

5. Shipping, Risk of Loss & Title

Shipping terms, timelines, insurance, and signature requirements are set out in our [Shipping Policy], which is incorporated into these Terms. Title and risk of loss pass to you upon delivery, as confirmed by carrier tracking and, where required, signature confirmation.

International customers are responsible for all customs duties, import taxes, and related fees. We declare full purchase value on all customs forms without exception.

6. Authenticity Guarantee, Returns & Refunds

All sales are final, subject to the authenticity guarantee and misdescription exceptions set out in our [Return & Refund Policy], which is incorporated into these Terms. Please read it before purchasing — it explains your rights, our security tag requirements, and the claim process.

7. Chargebacks & Disputes in Good Faith

If you have any issue with an order, contact us first at [hello@velvethammerluxury.com] — we resolve problems quickly and fairly. Initiating a chargeback without first contacting us, or making a fraudulent chargeback claim (such as claiming non-receipt of a package confirmed delivered with signature), constitutes a breach of these Terms. We document every shipment and will contest fraudulent chargebacks with carrier records, photographs, and signature confirmation.

8. Acceptable Use

You agree not to use the Site to:

• Violate any applicable law or regulation
• Infringe our intellectual property or that of others, including scraping or republishing our product photography and descriptions
• Interfere with the Site's operation or security, or attempt to access accounts or systems without authorization
• Place fraudulent orders or provide false information

We may suspend or terminate access to the Site for violations of these Terms.

9. Intellectual Property

All original content on the Site — photography, descriptions, branding, and design — belongs to Velvet Hammer Luxury and may not be used without our written permission. Third-party brand names and trademarks belong to their respective owners and are used only to identify genuine pre-owned goods. See our [Legal Notice] for details.

10. Disclaimers

Except as expressly provided in our Return & Refund Policy, the Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. Pre-owned goods carry no manufacturer's warranty. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, Velvet Hammer Luxury shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms limits rights you may hold under applicable consumer protection laws that cannot be waived by agreement.

12. Indemnification

You agree to indemnify and hold harmless Velvet Hammer Luxury and its owners and employees from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Site.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in [Multnomah County], Oregon, and you consent to their jurisdiction. Before filing any claim, both parties agree to attempt in good faith to resolve the dispute informally by contacting the other party.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Changes apply prospectively; the Terms in effect when you placed an order govern that order. Continued use of the Site after changes constitutes acceptance.

15. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Shipping Policy, Return & Refund Policy, Privacy Policy, and Legal Notice, constitute the entire agreement between you and Velvet Hammer Luxury regarding the Site.
